The Seller is a publisher of Commercial Products and Services intended for consumers, marketed via its website sweetcbdfrance.com. The list and description of the goods and services offered by the Company can be consulted on the aforementioned sites.

Article 1.A: Sweet CBD France products are EXCLUSIVELY reserved for use at your home only. This includes the fact that it is prohibited to transport our products unsealed outside of your home. The Sweet Pouch is an item intended for use only at your home, therefore it is not an item intended for the transport of our products but rather for storage at your home.

It is also prohibited to consume our products by combustion, in any form, in all public places.

Sweet CBD France is not responsible for the misuse of its products and the criminal penalties applied. In the event of sanctions and claims, Sweet CBD France will provide you with your invoice and all relevant analyses; please contact us by email at contact.hkdistribution@gmail.com.

Sweet CBD France prohibits the sale of its products to minors and pregnant women.

Article 1.B: Object


These General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products or Services offered by the Seller.

Article 2: General Provisions


These General Terms and Conditions of Sale (GTC) govern the sales of Products or Services, carried out through the Company's websites, and are an integral part of the Contract between the Buyer and the Seller. They are fully enforceable against the Buyer who has accepted them before placing an order. The Seller reserves the possibility of modifying these, at any time by the publication of a new version on its website. The GTC applicable then are those in force on the date of payment (or the first payment in the case of multiple payments) for the order.

The Company also ensures that their acceptance is clear and unreserved by setting up a checkbox and a validation click. The Customer declares having read all these General Terms and Conditions of Sale, and where applicable, the Specific Terms and Conditions of Sale related to a product or service, and accepts them without restriction or reservation.
The Customer acknowledges that they have benefited from the advice and information necessary to ensure the adequacy of the offer to their needs.
The Customer declares to be able to contract legally under French law or to validly represent the natural or legal person for whom they are committing.
Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

Article 3: Price


The prices of the products sold through the websites are indicated in Euros including all taxes and are precisely determined on the Product description pages. They are also indicated in euros including all taxes (VAT + other potential taxes) on the product order page, and excluding specific shipping costs. For all products shipped outside the European Union and/or French Overseas Territories (DOM-TOM), the price is calculated automatically excluding taxes on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Seller. They will be borne by the buyer and are their responsibility (declarations, payment to the competent authorities, etc.). The Seller invites the buyer to inquire about these aspects with the corresponding local authorities. The Company reserves the possibility of modifying its prices at any time for the future. The telecommunication costs necessary to access the Company's websites are the responsibility of the Customer. If applicable, delivery costs as well.

Article 4: Conclusion of the online contract


The Customer must follow a series of steps to conclude the contract electronically in order to place their order:
Information on the essential characteristics of the Product;
Choice of the Product, if applicable, of its options;
Indication of the Customer's essential contact details (identification, email, address...);
Acceptance of these General Terms and Conditions of Sale;
Verification of the elements of the order (double-click formality) and, if applicable, correction of errors. Before proceeding with confirmation, the Buyer has the possibility to verify the details of their order, its price, and to correct any errors, or cancel their order. The confirmation of the order will result in the formation of this contract.
Then, follow the instructions for payment, payment for the products, then delivery of the order. The Customer will receive confirmation by email of the payment for the order, as well as an acknowledgement of receipt of the order confirming it. They will receive a .pdf copy of these general terms and conditions of sale.
The customer will have the possibility during their ordering process to identify any errors made in the entry of data and to correct them. The language proposed for the conclusion of the contract is French.

The archiving of communications, the order, the order details, as well as invoices is carried out on a reliable and durable medium in order to constitute a faithful and durable copy in accordance with the provisions of Article 1360 of the Civil Code. This information can be produced as proof of the contract.
For products delivered, delivery will be made to the address indicated by the Customer. For the purposes of proper completion of the order, the Customer undertakes to provide true identification details. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.

Article 5: Products and services


The essential characteristics of the goods, services, and their respective prices are made available to the buyer on the company's websites, as is the method of use of the product, where applicable.
The consumer is informed, by way of marking, labeling, display, or any other appropriate process, of the prices and specific conditions of the sale and execution of services before any conclusion of the sales contract. In any case, the total amount due by the Buyer is indicated on the order confirmation page. The selling price of the product is the one in force indicated on the day of the order, which does not include the shipping costs billed in addition. These potential costs are indicated to the Buyer during the sales process, and in any event at the time of order confirmation. The Seller reserves the possibility of modifying its prices at any time, while guaranteeing the application of the price indicated at the time of the order. When products or services are not executed immediately, clear information is given on the product presentation page regarding the delivery dates of the products or services. The customer certifies having received a breakdown of delivery costs as well as the terms of payment, delivery, and execution of the contract, as well as detailed information relating to the identity of the seller, their postal, telephone, and electronic contact details, and their activities in the context of this sale. The Seller undertakes to honor the Customer's order only within the limits of available product stocks.

Article 6: Compliance


In accordance with Article L.411-1 of the Consumer Code, the products and services offered for sale through these GTC meet the requirements in force relating to the safety and health of people, the fairness of commercial transactions, and the protection of consumers.

Article 8: Delivery terms


The products are delivered to the delivery address that was indicated during the order and within the indicated deadlines. These deadlines do not take into account the order preparation time. When the Customer orders several products at the same time, they may have different delivery times delivered according to the following methods: delivery via one or more packages.
The Seller reminds that at the moment the Customer takes physical possession of the products, the risks of loss or damage to the products are transferred to them. It is the Customer's responsibility to notify the carrier of any reservations regarding the delivered product.

Article 9: Availability and presentation


In case of unavailability of an item for a period exceeding 30 working days, you will be immediately notified of the foreseeable delivery times and the order for this item may be canceled upon simple request. The Customer may then request a credit note for the amount of the item or its full refund and the cancellation of the order.

Article 10: Payment


Payment is due immediately upon ordering, including for pre-order products. The Customer can make the payment by payment card or bank check. Cards issued by banks domiciled outside of Europe must be international payment cards (Mastercard or Visa). Secure online payment by credit card is provided by our payment service provider XXXXXVivaWalletXXXXX. The information transmitted is encrypted according to the state of the art and cannot be read during transport on the network.
Once the payment is initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating their banking information during the sale, the Customer authorizes the Seller to debit their card for the amount relating to the price indicated. The Customer confirms that they are indeed the legal holder of the card to be debited and that they are legally entitled to use it. In case of error, or inability to debit the card, the Sale is immediately terminated by operation of law and the order canceled.

Article 11: Withdrawal period


In accordance with the provisions of the Consumer Code, the Buyer has the right to withdraw without giving any reason, within a period of fourteen (14) days from the date of receipt of their order.
The right of withdrawal can be exercised by contacting the Company in the following manner: filing a complaint at the address 10 Rue des Ponts, 13015, Marseille, France.
We inform Customers that in accordance with the provisions of the articles, this right of withdrawal cannot be exercised for any item for which a manufacturing or routing process is underway.
In case of exercise of the right of withdrawal within the aforementioned period, the price of the product(s) purchased and the shipping costs will be reimbursed, with the return costs remaining the responsibility of the Customer. Product returns must be made in their original condition and complete (unopened packages...); they must if possible be accompanied by a copy of the proof of purchase.

Article 12: Force majeure


The performance of the seller's obligations under these terms is suspended in the event of a fortuitous event or force majeure that would prevent their performance. The seller will notify the customer of the occurrence of such an event as soon as possible.

Article 13: Governing law and clauses


All clauses appearing in these general terms and conditions of sale, as well as all purchase and sale operations referred to therein, will be subject to French law. The nullity of a contractual clause does not entail the nullity of these general terms and conditions of sale
